CONDITIONS OF CARRIAGE
CLoVER Hire Conditions of Carriage Standard Conditions of Carriage for General Passenger Automobile Transport Business
(Scope of Application)
Article 1The transport contract concerning the general passenger automobile transport business operated by our company shall be governed by these Conditions of Carriage, and matters not stipulated in these Conditions of Carriage shall be governed by laws and regulations or general customs.
2If our company agrees to a special agreement regarding certain provisions of these Conditions of Carriage within a scope that does not contravene the purpose of these Conditions of Carriage and laws and regulations, that special agreement shall apply, notwithstanding the provisions of the relevant articles.
(Instructions of Employees)
Article 2Passengers must obey instructions given by our drivers and other employees for the purpose of ensuring transport safety.
(Acceptance of Carriage)
Article 3Our company shall accept the carriage of passengers, except in cases where acceptance or continuation of carriage is refused under the provisions of the next article or Article 4-2, Paragraph 2.
(Refusal of Acceptance and Continuation of Carriage)
Article 4Our company may refuse to accept or continue carriage in any of the following cases:
- (1) When the application for said carriage does not comply with these Conditions of Carriage.
- (2) When there are no facilities suitable for said carriage.
- (3) When a special burden is requested by the applicant regarding said carriage.
- (4) When said carriage is contrary to the provisions of laws and regulations or public order and morals.
- (5) When there is a disruption to carriage due to natural disasters or other unavoidable circumstances.
- (6) When a passenger does not comply with measures taken by the crew based on the provisions of the Passenger Automobile Transport Business Transportation Rules.
- (7) When a passenger carries knives or other items prohibited from being brought in under the provisions of the Passenger Automobile Transport Business Transportation Rules.
- (8) When a passenger carries items whose bringing in has been refused under the provisions of Article 4-3, Paragraph 3 or Paragraph 4.
- (9) When a passenger is so intoxicated that they cannot clearly state their destination or cannot walk without assistance.
- (10) When a passenger is dressed in unclean clothing that may soil the vehicle interior.
- (11) When a passenger is severely ill and not accompanied by an attendant.
- (12) When a passenger is suffering from a Class I infectious disease, Class II infectious disease, novel influenza equivalent infectious disease, or designated infectious disease (limited to those requiring hospitalization) under the Act on the Prevention of Infectious Diseases and Medical Care for Patients with Infectious Diseases (including those deemed to be such patients), or shows symptoms of a new infectious disease.
Article 4-2Passengers are requested to refrain from smoking inside our non-smoking vehicles (vehicles indicating they are non-smoking vehicles; the same applies in the next paragraph).
2If a passenger smokes or attempts to smoke inside our non-smoking vehicle, the driver may ask them to stop smoking, and if the passenger does not comply with this request, we may refuse to accept or continue carriage.
(Restrictions on Carrying Hand Luggage)
Article 4-3Passengers may not bring into the vehicle the items specified in Article 4, Item 7.
2If our company recognizes a possibility that the hand luggage (meaning items carried by passengers; hereinafter the same) contains the items mentioned in the preceding paragraph, we may ask the passenger to disclose the contents of the hand luggage.
3Our company may refuse to allow passengers who do not comply with the request under the preceding paragraph to bring in their hand luggage.
4If a passenger complies with the request under Paragraph 2, and the contents of their hand luggage are similar to the items in Paragraph 1 and difficult to distinguish, our company may refuse to allow them to bring in their hand luggage, unless the passenger provides reasonable proof that these are not such items.
(Fares and Charges)
Article 5The fares and charges collected by our company shall be those approved by the head of the local transport bureau or filed with the head of the local transport bureau and implemented at the time of the passenger's boarding.
2The fares and charges mentioned in the preceding paragraph shall be based on the amount agreed upon for an hourly contract.
(Collection of Fares and Charges)
Article 6Our company shall request payment of fares and charges at the time of the passenger's reservation, boarding, or alighting.
(Responsibility to Passengers)
Article 7Our company shall be liable for compensation for damages incurred when the life or body of a passenger is harmed by the operation of our vehicle. However, this shall not apply if our company and our employees prove that due care was exercised in the operation of the vehicle, that there was intent or negligence on the part of the passenger or a third party other than our employees, and that there were no structural defects or functional impairments in the vehicle.
2In the case of the preceding paragraph, our company's responsibility to the passenger begins at the time of boarding and ends upon alighting.
Article 8In addition to the provisions of the preceding article, our company shall be liable for compensation for damages incurred by passengers in relation to their carriage. However, this shall not apply if our company and our employees prove that due care was exercised in relation to the carriage.
Article 9Our company shall not be liable for compensation for damages incurred by passengers when, due to natural disasters or other reasons not attributable to our company, we temporarily suspend operation or take other measures to ensure transport safety.
(Passenger's Responsibility)
Article 10If our company suffers damage due to the intent or negligence of a passenger, or due to a passenger's failure to comply with laws and regulations or the provisions of these Conditions of Carriage, we shall demand compensation for such damage from that passenger.
